Boots Ireland Admits to Misleading Black Friday Discounts

Boots Ireland admitted to breaching pricing laws during its 2023 Black Friday promotions, following an investigation by the Competition and Consumer Protection Commission (CCPC). The case, heard in Dublin District Court, centered on misleading discount pricing for specific products, including electric toothbrushes and perfume.

Details of the Breach

The CCPC’s investigation revealed that Boots had advertised certain products with discounts that did not reflect the lowest price offered in the previous 30 days, as mandated by the European Union (Requirements to Indicate Product Prices) (Amendment) Regulations introduced in November 2022. For instance, a limited edition Oral-B iO 10 electric toothbrush was advertised at €470, down from a stated previous price of €999.99. However, records showed that the product had been sold at €470 in the days leading up to the promotion, making the higher “was” price inaccurate. Similar discrepancies were found with another Oral-B toothbrush and a bottle of Dior Eau de Toilette.

Court Proceedings and Outcome

Representatives for Boots attributed the pricing errors to human mistakes and emphasized that these instances were isolated, considering the vast number of products on promotion during the sales period. The company expressed remorse and highlighted steps taken to review and improve internal pricing procedures.

Judge Anthony Halpin acknowledged the company’s guilty plea and lack of prior convictions. He proposed applying the Probation of Offenders Act, which would allow Boots to avoid a formal conviction, contingent upon the company paying €4,624 towards CCPC costs and making a €1,000 donation to the Little Flower Penny Dinners charity by June 26.

Broader Implications

This case is among the first prosecutions under the new pricing regulations aimed at enhancing transparency in promotional pricing. The CCPC has emphasized the importance of accurate pricing information to ensure fair competition and maintain consumer trust. Other retailers, including Lifestyle Sports and DID Electrical Appliances, have faced similar charges and outcomes.

The Boots Ireland case underscores the critical importance of compliance with pricing regulations, especially during major sales events like Black Friday.
