The Incident

The victim had been out socializing on the night of the assault in 2021 when she suffered a fall and was subsequently taken to the hospital by ambulance. While at the hospital, she reached out to several acquaintances, including Troy, seeking assistance to return home. Troy arrived after 3 a.m., accompanied by another man. The victim accepted their offer of a ride, hoping to get home safely. ​

Assault in the Vehicle

During the journey, Troy initiated unwanted advances by kissing the victim, causing her to feel disgusted and uncomfortable. Despite her clear indications that she wished to go home, Troy persisted. This initial assault set a distressing precedent for the events that followed.

Ordeal at Home

Upon reaching her residence, the victim was assisted inside by Troy and the other man. After the second man departed, leaving her alone with Troy, the situation escalated horrifically. Troy proceeded to rape, anally rape, and sexually assault her in her bedroom, exploiting her vulnerable state and betraying the trust she had placed in him.

Aftermath and Legal Proceedings

The following day, the victim bravely reported the assault to the authorities and underwent an examination at a Sexual Assault Treatment Unit. The forensic analysis yielded a DNA profile matching Troy, providing compelling evidence against him. During police interviews, Troy claimed that the sexual encounter was consensual, a defense that was ultimately rejected by the court.

Victim’s Impact Statement

In a poignant victim impact statement, the woman articulated the profound and lasting effects of the assault on her life. She expressed feelings of anxiety, trust issues, and an inability to maintain employment. Her words resonated with the court: “I don’t know what I did to deserve this… He destroyed my life.” She further stated her unwillingness to forgive Troy, emphasizing the deliberate nature of his actions.

Court’s Sentencing and Remarks

Presiding over the case, Ms. Justice Melanie Greally highlighted several aggravating factors, including the multiple violations, the use of physical force, and the elements of degradation involved.
